Activity: electronic commerce in sunglasses. The website is www.flyper.it.

This information is made accessible in an easy, direct and permanent manner under Article 7 of Legislative Decree 70/2003, implementing Directive 2000/31/EC on electronic commerce.

02What is here, and what is not

The website is a showcase and a shop: it presents the models, tells where they come from, and lets you buy them.

There is no registration and no account to create. You buy as a guest, entering your delivery details at checkout. There are therefore no credentials to look after, no password to choose and no profile to manage. If we introduce a customer area in future, this page will say so.

The site hosts no user-uploaded content, has no comment area, and does not allow reviews to be posted.

03What you may do

You may consult, browse, save and print the pages for personal use, quote short extracts citing the source, and link to the site from another site, provided the link does not present Flyper falsely or disparagingly, or suggest a commercial relationship that does not exist.

04What you may not do

  • use the site for unlawful purposes or in breach of these rules;
  • reproduce, distribute or publish the site’s content for commercial purposes without our written consent;
  • systematically extract the content, by automated or manual means, to build a database or to train a system;
  • attempt to reach non-public areas or data, circumvent security measures, or introduce malicious code;
  • deliberately overload the infrastructure or interfere with others’ use of the site;
  • remove or alter the trade marks, signatures and ownership notices carried by the content.

Where we detect such use we may restrict or block access, without prejudice to the remedies provided by law.

05Intellectual property

The Flyper trade mark, the logo, the model names, the texts, the photographs, the frame designs, the page design and the site’s code belong to FLYPER S.r.l. or are licensed to it, and are protected by copyright, trade mark and design law.

Nothing on this page transfers or grants rights in that content beyond the consultation permitted in section 3.

The archive photographs of the aviators shown on the model pages come from historical sources. If you believe you hold rights in any published image, write to customercare@flyper.it: we check and, if the point is well founded, we remove or attribute without argument.

06Accuracy of the content

We look after the information we publish and correct it as soon as we notice an error. Prices, availability and specifications may change.

The contractually relevant information is what is displayed when the order is placed and summarised in the order confirmation. Pricing errors are dealt with in the Terms and conditions of sale.

The historical accounts of the aviators and their flights are editorial material, not statements about the characteristics of the product.

07Availability

We do what we can to keep the site reachable, but we do not promise uninterrupted availability: there may be interruptions for maintenance, provider failures, network problems or events beyond our control. Where possible we give notice in advance.

An interruption does not affect any order already concluded and does not affect any of the rights described in the Terms and conditions of sale and in Returns and refunds.

08Liability

We are liable as the law provides. In particular, we neither exclude nor limit in any way our liability for wilful misconduct or gross negligence, for personal injury, for liability for defective products, or for the mandatory rights of consumers.

Only to the extent the law permits, we are not liable for indirect damage arising from a temporary inability to reach the site, nor for the content of third-party sites reachable from links here, which we do not control and which remain governed by their own terms.

No clause on this page is intended to cause a significant imbalance in the parties’ rights and obligations to the detriment of the consumer. Any clause capable of being classified as unfair under Articles 33 and following of the Italian Consumer Code is to be treated as not having been included.

09Personal data

The processing of personal data is described in Privacy policy; the storage technologies used by the site are listed one by one in Cookie policy.

10Accessibility

We want the site to be usable by people navigating with a keyboard, with a screen reader, with enlarged text, or with animation switched off. The site is built with semantic structure and landmarks, works entirely from the keyboard, provides text alternatives for images, keeps an adequate contrast ratio in both themes, and honours the system preference for reduced motion.

If you meet a barrier, write to customercare@flyper.it describing the page and the tool you are using: we reply within thirty days and, where possible, provide the content in an accessible alternative form.

The accessibility statement provided for by Legislative Decree 82/2022, implementing Directive (EU) 2019/882, is published on this page once the conditions making it mandatory apply.

11Reports and complaints

For anything concerning the site, its content or its accessibility: customercare@flyper.it or +39 06 9293 6111. We reply within thirty days. Complaints about a purchase follow the procedure described in the Terms and conditions of sale.

12Governing law

Use of the site is governed by Italian law. For disputes with a consumer, the court of the consumer’s place of residence or elected domicile has exclusive and non-derogable jurisdiction under Article 66-bis of the Italian Consumer Code. For all others, the Court of Campobasso has jurisdiction.

13Changes

We may update this page. The version in force is the one published, carrying the date shown at the top. Changes have no effect on orders already concluded, which remain governed by the terms in force when the order was placed.
