Referred to below as "Flyper", "the seller", "we". "Website" means www.flyper.it and its subdomains. "Products" means the sunglasses and accessories offered for sale on the Website.

"Consumer" means a natural person acting for purposes outside their trade, business, craft or profession, as defined in Article 3(1)(a) of the Italian Consumer Code (Legislative Decree 206/2005). The consumer protections set out below do not apply to a purchase made in the course of a business: in that case we issue an invoice on request and the right of withdrawal does not apply.

02Who may purchase

Purchasing requires being at least eighteen years old and having legal capacity. By placing an order the customer confirms this is the case.

Where an order turns out to have been placed by a minor without the consent of a parent or guardian, the order is cancelled and the amount refunded in full.

03The products

Flyper sunglasses are category I personal protective equipment under Regulation (EU) 2016/425, intended to protect the eye against solar radiation. They carry the CE marking, conform to EN ISO 12312-1, and are supplied with the EU declaration of conformity and the instructions for use, included in the box and available on request.

They are not medical devices and they are not prescription eyewear. They do not correct vision, do not replace the advice of an optician or ophthalmologist, and are not intended for driving in low light where the lens category does not permit it. The solar filter category of each model is stated on the product page and in the instructions.

The photographs, colours and measurements published on the Website describe the product as accurately as possible. Since the frames are hand-finished cellulose acetate, slight differences in grain, tone and finish from one piece to another are inherent in the material and the process and do not constitute a lack of conformity.

The models are produced in numbered series. The number of the individual piece is stated on the certificate supplied with the product; the temple carries a silkscreen mark. Once a series is sold out it is not reprinted.

04How the contract is concluded

  1. The customer selects the products, the colour variant and any options, and adds them to the cart.
  2. On the checkout page the customer enters the delivery details and selects a payment method. Before confirming, the customer sees the full summary: products, variants, quantities, unit price, any charges and the total payable.
  3. By pressing the payment button, which states the exact amount, the customer submits a binding offer to purchase and authorises the charge.
  4. The contract is concluded at the moment payment succeeds and the order is recorded by our system.
  5. Immediately afterwards we send an order confirmation to the email address provided, stating the seller’s details, the products purchased, the total price paid, the delivery time, the information on the right of withdrawal and the model withdrawal form. This confirmation constitutes confirmation of the contract on a durable medium under Article 51(7) of the Italian Consumer Code.

If the confirmation does not arrive within a few hours, please check the spam folder and, failing that, write to customercare@flyper.it. These terms can be saved and printed from this page at any time.

We may refuse or cancel an order, including after payment, in the event of: unavailability of the product, suspected fraud or unauthorised transaction, manifest error in price or description, incomplete or incorrect delivery details that cannot be resolved, or breach of these terms. In each of these cases we refund the full amount paid within fourteen days, using the same payment method, at no cost to the customer.

05Prices

Prices are displayed in the currency selected by the customer, euro or US dollar. The order is concluded and charged in the currency shown at the time of confirmation, which is also the currency of the order confirmation and of any refund. The conversion rate applied is the one configured in our system at the time of the order; the customer’s bank or card issuer may apply its own currency fees, over which we have no control.

The price displayed includes:

  • value added tax, where due under the law applicable to the destination;
  • shipping costs;
  • customs duties and import taxes for shipments outside the European Union.

No further amount is due on delivery, either to the carrier or to the customs authorities. If, in exceptional circumstances beyond our control, the customer is asked to pay at customs, the amount is refunded on presentation of the receipt.

The applicable price is the one displayed when the order is placed. A subsequent increase has no effect on orders already concluded.

Where a price reduction is announced, we state alongside the reduced price the lowest price applied in the previous thirty days, as required by Article 17-bis of the Italian Consumer Code.

If a manifest clerical error causes a product to be displayed at an obviously incorrect price, and the error is recognisable as such, we are not bound to supply at that price: we inform the customer without delay and leave the choice between confirming at the correct price or cancelling with a full refund.

06Payment

Payment is made by credit, debit or prepaid card, through the payment service provider Stripe Payments Europe Ltd. Card details are collected directly by Stripe inside a secured form and never pass through or rest on our systems. Any further payment methods, once enabled, are shown and selectable on the checkout page.

The amount is charged when the order is confirmed. Payment may require the strong customer authentication (SCA) provided for by Directive (EU) 2015/2366: confirmation then goes through the bank’s application or a code sent by the card issuer.

If authorisation fails, the contract is not concluded and no amount is definitively charged. Any hold placed on the card limit is released by the issuer according to its own timing, over which we have no control.

Where an invoice is requested, it is issued electronically and transmitted through the Italian Interchange System in accordance with applicable law. Customers requiring an invoice must provide their tax code at checkout and, where they are a taxable person, their VAT number and recipient code or certified email address.

07Delivery

We ship to Italy, the European Union and the international destinations served by our carriers. The list of available destinations is the one selectable on the checkout page.

We deliver within thirty days of the conclusion of the contract, unless a different period is agreed in writing with the customer. This is the maximum period set by Article 61 of the Italian Consumer Code. The indicative actual times, which are considerably shorter, are set out in Shipping and delivery.

If we fail to deliver within the period, the customer may set us an additional reasonable period in writing. If that period also passes without delivery, or if the original period was essential, the customer is entitled to terminate the contract and obtain a full refund without undue delay.

The risk of loss of or damage to the products passes to the customer only when the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods (Article 63 of the Italian Consumer Code). Until then the risk remains with us: if a shipment is lost or arrives damaged, we replace it or refund it at no cost to the customer.

On receipt we recommend checking that the packaging is intact. Raising the matter with the carrier at the time of delivery helps the claim, but not doing so in no way prejudices the customer’s rights against us.

08Right of withdrawal

Fourteen days to change your mind

The consumer has the right to withdraw from the contract within fourteen days, without giving any reason and without any penalty.

The period runs from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the products. Where an order comprises several products delivered separately, the period runs from delivery of the last one.

Return costs are borne by us. This is more favourable than the law, which would place them on the consumer, and we take them on.

How to exercise it

An explicit and unequivocal statement, sent before the fourteen days expire, to customercare@flyper.it or by post to Via Umberto I, 25/A, 86100 Campobasso (CB), Italy, is sufficient. The model form reproduced in Returns and refunds may be used but is not compulsory: any communication clearly expressing the decision to withdraw is valid. It is enough that the communication is sent before the deadline.

What happens next

The consumer returns the products without undue delay and in any event within fourteen days of communicating the withdrawal. We arrange collection or send the return label.

We refund all payments received, including the standard delivery costs, without undue delay and in any event within fourteen days of the day we are informed of the withdrawal. The refund is made using the same payment method used for the purchase, unless otherwise agreed, and involves no cost for the consumer. We may withhold the refund until we have received the products or until the consumer has supplied evidence of having sent them back, whichever is earlier.

The limit

The consumer is liable only for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning (Article 57 of the Italian Consumer Code). In practice: trying the glasses on is allowed and does not reduce the refund; wearing them out, scratching them, or returning them without the case, cloth, certificate and original packaging exposes the consumer to a proportionate reduction of the refund, which we quantify and explain in writing.

The right of withdrawal does not apply to purchases made by persons who are not consumers.

10Liability

Nothing in these terms excludes or limits our liability where the law does not permit it: in particular for wilful misconduct or gross negligence, for personal injury, for liability for defective products under Articles 114 and following of the Italian Consumer Code, and for the mandatory rights of consumers.

To the extent permitted by law, we are not liable for indirect damage arising from use of the Website or of the products otherwise than in accordance with the instructions, nor for interruptions of the Website due to maintenance, third-party provider failures or events beyond our reasonable control.

We are not liable for failure or delay in performance caused by exceptional and unforeseeable events beyond our control, such as natural disasters, acts of authority, general strikes, disruption of transport or of customs crossings, or epidemics. In such cases we inform the customer without delay and, if the impediment persists, the customer may terminate the contract and obtain a full refund.

11Complaints and dispute resolution

Complaints should be addressed to customercare@flyper.it or by post to the registered office. We reply within thirty days.

The European ODR platform no longer exists. Regulation (EU) 524/2013 was repealed by Regulation (EU) 2024/3228 and the platform ceased operating on 20 July 2025: the links to ec.europa.eu/consumers/odr still found on many websites lead nowhere.

We do not currently subscribe to any alternative dispute resolution body. The consumer nonetheless retains the right to apply to the ADR bodies listed by the competent authorities under Articles 141-bis and following of the Italian Consumer Code, and to initiate the mediation procedure provided for by Legislative Decree 28/2010. A consumer resident in another European Union Member State may contact the European Consumer Centres Network (ECC-Net), which assists free of charge with cross-border purchases.

12Governing law and jurisdiction

The contract is governed by Italian law. The mandatory provisions more favourable to the consumer under the law of the country of their habitual residence continue to apply, pursuant to Article 6 of Regulation (EC) 593/2008.

For disputes with a consumer, the court of the consumer’s place of residence or elected domicile has exclusive and non-derogable jurisdiction (Article 66-bis of the Italian Consumer Code).

For disputes with persons who are not consumers, the Court of Campobasso has exclusive jurisdiction.

13Amendments

We may amend these terms. The terms applicable to an order are always and only those published at the moment the order was placed: a later amendment does not affect contracts already concluded. The version in force carries the date of the last update at the top.

14Miscellaneous

The invalidity or unenforceability of any single clause does not affect the others. Failure to act on a breach is not a waiver of the right to act on it later.

Under Articles 33 and following of the Italian Consumer Code, no clause of these terms is intended to cause a significant imbalance in the parties’ rights and obligations to the detriment of the consumer. Any clause capable of being classified as unfair is to be treated as not having been included.
